Following Ivano-Frankivsk, such a document appeared in Kyiv - on the Facebook page of the Obolon District TCC. The printed order was also pasted near the entrances, which raised many questions from the locals. However, the capital's TCC did not provide an explanation, and the comments under the publications were closed.
The head of the Obolon district TCC and SP, Colonel Oleksiy Pryvala, notes that the order was issued in connection with the continuation of martial law and general mobilization in Ukraine.
“All conscripts who live in the Obolon district of Kyiv and have mobilization orders, or if they receive personal summonses, to appear on the dates and at the addresses specified in their mobilization orders, personal summonses or orders,” they emphasize in the assembly center.
In addition, all conscripts who have not received personal summonses are ordered to arrive at the center within 10 days from the date of publication of the document, i.e., by June 29, 2023.
Those conscripts who are registered in other recruitment centers and temporarily stay in the territory of the district due to any circumstances should also come to the Obolon RTCC, the document says.
At the end of the document, it is emphasized that evaders are responsible according to the legislation of Ukraine. Article 336 of the Criminal Code is cited. It provides for punishment in the form of deprivation of liberty for a term of three to five years.
“If you fail to appear at the Territorial Center for Recruitment and Social Support without valid reasons, you will be prosecuted in accordance with the law and handed over for search, detention, and delivery to the TCC and SP by the National Police,” warns Colonel Oleksiy Pryvala.
According to attorney Maryna Bekalo, the order of the head of the Obolon Territorial Recruitment Center regarding the notification of conscripts being called up to the center does not comply with the procedure provided for by the current legislation and does not oblige them to appear at this recruitment center according to such an order.
"That is, a citizen should appear at the TCC SP if he receives a summons document, and not read somewhere in an announcement placed on the fence or in the front of his house," Marina Bekalo said.
The specified resolution also establishes the procedure for serving such summonses to conscripts, namely: serving summonses under their personal signature at their place of residence (paragraph 32 of the resolution).
Marina Bekalo added that the notification can also be implemented through the employer. In this case, he undertakes the duty to notify his employee. The employer must issue an appropriate order at the enterprise (institution or organization), hand the employee a summons to the TCC and SP, ensure his attendance and report to the recruitment center on the implementation of all these measures (clause 47 of the resolution).
